Arbitration and EU Law: Open Issues and Enduring Challenges

Conference organized by the Max Planck Institute Luxembourg and the Academy of European Law (ERA), which will take place in Trier (Germany) on 10 - 11 March 2014.

The conference will address, firstly, the recast of the Brussels I Regulation (No. 1215/2012) and its connection to arbitration. Article 1(d) of the Brussels I Regulation ("This Regulation shall not apply to arbitration“) will be discussed in-depth. Do we have clear cut answers to jurisdictional issues? How are arbitral awards to be enforced? Furthermore, the discussion will focus on insolvency and arbitral proceedings.

The following part of the conference will deal with the interrelationship between arbitration and procedural minimum standards according to Article 6 of the European Convention on Human Rights.

On the second day of the conference, investment arbitration, namely the problems of compatibility of investment treaties with EU law, will be discussed. The question will be raised whether arbitrators are the guardians of public policy.
