Towards more EFfective enFORcemenT of claimS in civil and commercial matters within the EU

International Exchange Seminar

The International Exchange Seminar is organised by the MPI Luxembourg as part of EFFORTS (Towards more EFfective enFORcemenT of claimS in civil and commercial matters within the EU), a two-year project funded by the Civil Justice Programme of the European Commission (JUST-JCOO-AG-2019-881802) and carried out by an international Consortium composed by the MPI Luxembourg and the Universities of Milan (coord.), Brussels VUB, Heidelberg, Vilnius, and Zagreb.

Adopting a comparative and practice-driven approach, EFFORTS analyses the implementation of the Brussels I bis Regulation and the Regulations on the European Enforcement Order, the European Small Claims Procedure, the European Payment Order, and the European Account Preservation Order in the national legislation and case-law of seven Member States (Belgium, Croatia, France, Germany, Italy, Lithuania, and Luxembourg). By doing so, EFFORTS promotes the exchange of practices among operators and collects good practices, with a view to assessing the interaction between the EU Regulations on the recognition and enforcement of judgments and extra-judicial titles and the national laws of the Member States addressed.

Against this backdrop, the upcoming International Exchange Seminar will pursue the research activities conducted so far within the framework of EFFORTS, including the National Reports on Implementing Rules and Case-Law that were drafted by the members of the Consortium and the National Exchange Seminars that have gathered experts in international procedural law coming from all the Member States addressed. Building on these deliverables, the event will feature four thematic presentations tackling some of the most salient issues uncovered by the Project to date and it will encourage the debate among participants on the current state and possible improvements of cross-border enforcement of claims within the EU.

In order to foster the exchange among policy-makers, users and experts of EU law, the International Exchange Seminar will bring together representatives from European and national administrations and judiciaries, legal scholars, in-house counsels, and practitioners coming from approximately ten Member States.
